When Is a Site Safety Plan Required in NYC?

In New York City, who must sign off on a Site Safety Plan (SSP) depends on the size and type of the construction project. Below is a breakdown of when SSPs are required and how they're reviewed.

Site Safety Plans for Major Buildings

For projects involving major buildings, a site safety plan must be submitted to the NYC Department of Buildings (DOB) through the DOB NOW: Build system before a permit can be issued.

Site Safety Plans must be submitted for review and approval to the Department when the scope of work meets specific thresholds outlined in Section 3310.1 of the NYC Building Code:

  1. The construction of a new major building
  2. Vertical or horizontal enlargement of a major building
  3. Full or partial demolition of a major building
  4. Façade repair or maintenance on a major building over 14 stories or 200 feet in height, if the work requires a sidewalk shed
  5. Any work on a building designated by the Commissioner due to site-specific hazards

Exception: The requirements of this section shall not apply to partial demolition operations limited to the interior components of a major building provided no mechanical demolition equipment, other than handheld devices, are used.

Site Safety Plans for projects that require a Licensed Construction Superintendent

As per Local Law 81 of 2017, effective November 6, 2017, all jobs requiring a Registered Construction Superintendent must have a Site Safety Plan. These SSPs are not submitted to the DOB but must be signed by the preparer and kept on-site.

In accordance with Section 3301.13.1, if a primary Construction Superintendent is required under Section 3301.13.3, a Site Safety Plan that complies with Article 110 of Chapter 1, Title 28 of the Administrative Code must be maintained on-site and made available to the Department upon request.
